Overview

This website (barlume.fi) is operated by Barlume Vintage, a registered auxiliary business name (aputoiminimi) of Bella Industries Oy, a limited company registered in Finland and operating from the Helsinki capital region (Business ID / Y-tunnus 3339599-3). In these Terms of Service, the terms "we", "us", "our" and "Barlume" refer to Barlume Vintage / Bella Industries Oy.

These Terms of Service ("Terms") govern your access to and use of our website and your purchase of products from us. By accessing the site or placing an order, you agree to these Terms. Our store is hosted on Shopify, which provides the e-commerce platform that enables us to sell to you, and payments are processed by Paytrail Plc (see Section 17).

Nothing in these Terms limits or excludes any rights you have as a consumer under mandatory provisions of Finnish law, in particular the Finnish Consumer Protection Act (Kuluttajansuojalaki 38/1978), or under the consumer law of your own country of residence in the EU. Where any term of this document conflicts with such mandatory consumer rights, those mandatory rights prevail and the conflicting term does not apply to you as a consumer.

1. Eligibility

You must be at least 18 years of age (the age of majority in Finland) to place an order, or have the consent of a parent or guardian. By placing an order you confirm that you meet this requirement.

You may not use our products or this site for any unlawful or unauthorised purpose, and you must not transmit any malware or other harmful code or attempt to interfere with the security or operation of the site.

2. Products, descriptions and condition

Barlume specialises in curated vintage and second-hand design, décor and lighting, alongside a smaller selection of new or restored items. We describe each item, including its age and condition, as accurately as we reasonably can, and we photograph items as faithfully as possible. Because screens vary, we cannot guarantee that the colours shown on your device exactly match the item.

Vintage and second-hand items are sold in used condition. The description and photographs for each item form part of the contract, and the item’s conformity is assessed against that stated condition, age and description. Signs of age and wear consistent with the description are not defects. This does not affect your statutory rights in respect of any item that does not correspond to its description or is otherwise not as agreed.

We may limit the quantities we sell, limit sales to particular regions, or discontinue any product. Where an item is unique (as most vintage pieces are), only one is available.

3. Prices and VAT

Prices are shown in euros and include Finnish value added tax (VAT) where applicable. The total price payable, including taxes and any delivery costs, is shown to you before you confirm your order. We do not add undisclosed fees during checkout.

Most of our vintage items are sold under the second-hand margin scheme (marginaaliverotus). Under this scheme, VAT is calculated on our profit margin and is already included in the price shown; it is not stated separately on the invoice and is not deductible by the buyer. Items that are new, or that have been substantially modified or restored, are sold subject to standard Finnish VAT, which is included in the displayed price at the prevailing statutory rate (25.5% as of the date of these Terms). Delivery or shipping services may be subject to additional VAT.

We may correct obvious pricing errors. If a genuine error affects an order you have already placed, we will contact you and give you the choice of confirming the order at the correct price or cancelling it for a full refund before the item is dispatched. Prices may change for future orders, but a change does not affect an order already confirmed by us.

4. Orders and formation of contract

Your order is an offer to purchase. A binding contract of sale is formed when we send you an order confirmation. We reserve the right to decline or cancel an order before that point, for example where an item is no longer available or where we reasonably suspect fraud; if we decline or cancel and you have already paid, we will refund you in full without undue delay.

You agree to provide accurate and complete order and contact information so that we can fulfil your order and contact you if needed.

5. Your right of withdrawal (14 days)

As a consumer buying at a distance, you have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with Chapter 6 of the Finnish Consumer Protection Act.

The 14-day period begins on the day you (or a third party indicated by you, other than the carrier) take physical possession of the goods, or of the last item where an order is delivered in several parts.

To exercise this right, you must inform us of your decision to withdraw by a clear statement before the period expires. You may use our Withdrawal form, the online cancellation / withdrawal function available in our store (see Section 6), or any other unambiguous statement sent to info@barlume.fi. To meet the deadline, it is enough that you send your communication before the 14-day period has expired.

Effects of withdrawal: We will reimburse all payments received from you, including the standard delivery cost (but not any extra cost arising from your choice of a more expensive delivery method than our standard option), without undue delay and in any event within 14 days of the day on which we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent them back, whichever is earlier. We will use the same means of payment you used, unless you agree otherwise; you will not incur any fees as a result of the reimbursement.

You must send back or hand over the goods without undue delay and in any event within 14 days of communicating your withdrawal. You will bear the direct cost of returning the goods. You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Exceptions: The right of withdrawal does not apply to certain contracts, for example goods made to the consumer’s specifications or clearly personalised, and sealed goods unsuitable for return for health or hygiene reasons once unsealed. Where an exception applies to a particular item, we will say so clearly before you order.

6. Online withdrawal function

Where you have a statutory right of withdrawal, you can exercise it using our dedicated Withdrawal form.

Using this function is one way to withdraw; you may still withdraw by the withdrawal form or any other clear statement as described in Section 5. After you submit a withdrawal through the function, we will send you confirmation of receipt on a durable medium without undue delay.

7. Statutory guarantee — faulty or non-conforming goods

We are liable for goods that do not conform to the contract under the Finnish Consumer Protection Act. If an item does not correspond to its description, you are entitled to the statutory remedies — typically repair or replacement, and where appropriate a price reduction or cancellation of the purchase with a refund. These statutory rights apply in addition to, and are not limited by, the right of withdrawal in Section 5, and they cannot be excluded or restricted by these Terms. 9. Intellectual property and use of the site

The content of this site — including text, images, and the site’s design — belongs to us or our licensors and is protected by intellectual property rights. You may not reproduce, copy, sell or commercially exploit any part of the site or its content without our prior written permission. This does not prevent ordinary personal use of the site for browsing and shopping.

You agree not to use the site to act unlawfully; to infringe others’ rights; to harass, defame or discriminate against others; to submit false information; to upload malicious code; to harvest others’ personal data; or to interfere with the site’s security or operation.

10. User submissions

If you send us comments, ideas or other materials (for example product feedback or reviews), you grant us the right to use, edit and publish them without obligation to keep them confidential, to compensate you, or to respond. You are responsible for the content you submit, you confirm it does not infringe anyone’s rights or contain unlawful or harmful material, and you agree not to misrepresent your identity. We may, but are not obliged to, remove content we consider unlawful or objectionable.

11. Third-party links and tools

The site may contain links to, or make available tools from, third parties that we do not control. We provide access to such links and tools "as is" and are not responsible for their content, accuracy or policies. Your use of third-party sites and tools is at your own risk and subject to those third parties’ own terms. This does not affect our own obligations to you under these Terms and applicable law.

12. Availability of the site

We aim to keep the site available and accurate but do not guarantee that it will always be uninterrupted or error-free, and the general information on the site is provided for guidance. We may modify or suspend the site, or correct errors and omissions, at any time. This clause concerns the website itself and does not limit our obligations in respect of orders you have placed or goods you have purchased.

13. Liability

We are liable to you for loss caused by our breach of these Terms or our negligence in accordance with, and to the extent provided by, applicable Finnish law. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited.

Subject to the paragraph above, we are not liable for losses that were not reasonably foreseeable, or for losses arising from circumstances outside our reasonable control. Our liability is determined in accordance with the Finnish Consumer Protection Act and other applicable law.

14. Severability and entire agreement

If any provision of these Terms is found unlawful or unenforceable, that provision is severed and the remaining provisions continue in force. These Terms, together with the policies referred to in them (Privacy Policy, Refund Policy, Shipping Policy and the withdrawal form), form the agreement between us regarding your use of the site and your purchases. Our failure to enforce any provision is not a waiver of it.

15. Changes to these Terms

We may update these Terms from time to time by posting the revised version on this page with an updated "Last updated" date. Changes apply to orders placed after the change takes effect; the version of the Terms in force when you placed your order governs that order.

16. Governing law and dispute resolution

These Terms are governed by Finnish law. If you are a consumer resident in another EU country, you also retain the protection of the mandatory consumer provisions of the law of your country of residence.

If a dispute arises and it cannot be resolved by contacting us directly, you may, as a consumer, refer the matter to out-of-court dispute resolution:

You also have the right to bring proceedings before the courts. A consumer may bring an action in the courts of their own place of residence.

17. Payments — Paytrail Plc

Payments via the Barlume webshop are handled by Paytrail Plc (Business ID 2122839-7), unless otherwise stated. Paytrail is an authorised Finnish payment institution and acts as a collecting payment service provider; it will appear as the recipient on your bank or card statement and forwards the payment to us. For reclamations relating to a purchase, please contact us directly.
